Acceptance of Terms

By accessing and using BrainyTech's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Services Description

BrainyTech provides custom software development, web development, mobile app development, UI/UX design, and related technology services. Our services include but are not limited to:

• Custom software development
• Web and mobile application development
• UI/UX design services
• Cloud solutions and migration
• AI and machine learning solutions
• Technical consulting and support

Client Responsibilities

Clients agree to:

• Provide accurate and complete project requirements
• Respond to requests for information in a timely manner
• Provide necessary access to systems and resources
• Make payments according to agreed terms
• Respect intellectual property rights
• Not use our services for illegal or harmful purposes

Intellectual Property

Upon full payment for services, clients will own the intellectual property rights to custom-developed solutions, except for:

• Pre-existing BrainyTech intellectual property
• Third-party components and libraries
• General methodologies and know-how
• Tools and frameworks developed by BrainyTech

Payment Terms

Payment terms are specified in individual project agreements. Generally:

• Payments are due according to project milestones
• Late payments may incur additional charges
• Work may be suspended for overdue payments
• All prices are exclusive of applicable taxes

Warranties and Disclaimers

We provide services "as is" and make no warranties except as specifically stated in project agreements. We disclaim all other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

In no event shall BrainyTech be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Termination

Either party may terminate services with written notice. Upon termination:

• Client must pay for all work completed to date
• BrainyTech will deliver completed work components
• Both parties will return confidential information
• Surviving clauses will remain in effect
